Promoter “Rust” Kari T. Morrissey want another chance to try Alec Baldwin …and asked the judge to reconsider the decision to dismiss the manslaughter charge against the actor.
In new court documents filed Wednesday … Morrissey went after the judge Mary Marlowe Summerreasons for rejecting the case — in which she ruled that Baldwin had been harmed by the prosecution’s suppression of evidence.
This means Baldwin could not be charged with manslaughter again in the case… but prosecutors are now asking the judge to reconsider his decision.
In the documents, the prosecutor insists that while certain evidence was suppressed — including live ammunition shell casings found on the set — Baldwin’s defense team was aware of its existence before the trial and, in any case, the evidence was not relevant to his defense in any way.

According to prosecutors, “there was no cover-up because there was nothing to cover up.”
The live ammunition in question was first delivered to the Santa Fe County, New Mexico, Sheriff’s Office during the “Rust” shooting. Hannah Gutierrez-Reedjudgment of.
Reed is now serving a 18 month prison sentence after being found guilty of manslaughter… after the film’s cinematographer, Halyna Hutchinswas shot and killed by a gun held by Baldwin on set.

As for the live ammunition evidence… it was later revealed that the evidence was filed under a different case number — but Baldwin’s lawyers said they were not notified about it.
The prosecutor claims that “it was still Alec Baldwin’s responsibility to handle his prop gun safely and not point the gun at anyone (much less two people at once), to cock the gun when the scene did not require it, and to pull the trigger of the gun when the scene did not require him to pull the trigger.”
We’ve reached out to Baldwin’s reps for comment… so far, no response.
