Diddy is asking a judge to dismiss Jane Doe’s lawsuit alleging sexual misconduct against him… and he lays out a few different reasons.
According to the filing, obtained by TMZ, Diddy’s lawyers want Jane Doe’s lawsuit – in which she alleges she was raped by Diddy and others at age 17 in 2003 – dismissed with prejudice… and they say that the statute of limitations of the statute under which she is suing has lapsed.
In other words, Diddy’s lawyers say this woman missed an opportunity to sue – but more importantly, they point out… she didn’t include many pertinent details – outside of her alleged assault – which they think makes her claims no paper. thin and not worthy of being heard.
The lawyers also criticized the fact that she placed a “trigger warning” in her original lawsuit – something they claim was likely done to draw attention to the salacious nature of her claims – which Diddy’s lawyers say is completely without merit.
They write: “The scant amendments to the original Complaint cannot remedy the falsehoods and incurable defects of the new petition. Like the original Complaint, it presents no viable claim and must be dismissed.”
The attorneys add: “Plaintiff cannot claim what day or time of year the alleged incident occurred, but rather miraculously recalls the most salacious details with specificity. Consequently, this case must be dismissed now, with prejudice, to protect the defendants from Stops future reputational damage and before more partisan and judicial resources are wasted.”
Also remember… this woman who sued Diddy how Jane Doe actually invoked Cassiathe name in her OG complaint – and interestingly, she is represented by the same lawyers.
As we reported… Jane Doe claims she met Bad Boy Prez Harvey Pierre in 2003, in Detroit – only to be flown to New York, to Diddy’s studio… where she claims she met Diddy, fell prey to alcohol and drugs, and was gang-raped. She attached photos of the alleged encounter.
Now, Diddy is asking the court to dismiss his lawsuit – this after he I did something similar in a separate civil case… where he also asked for the dismissal of some claims brought by another alleged victim who sued him. Mind you, he’s doing this while a federal investigation continues.
Diddy has vehemently denied all of the allegations against him so far — and he’s fighting back.
