LA County District Attorney George Gascón is ready to announce his decision on whether he will recommend Erik and Lyle Menendez get out of jail free and we are broadcasting live here.
Gascón could go one of two ways: either ask a judge to resentence the brothers to time served, or ask the judge to vacate the murder conviction and impose a manslaughter conviction.
The maximum in California for manslaughter is 11 years, and the brothers served nearly 35 years — so if the judge goes that route, they will be released.
Thursday’s press conference comes after Gascón announced earlier this month that he was reevaluating the case after new evidence was presented – a letter Erik wrote to his cousin Andy Cano months before the murders, in which he says his father Joseph was still harassing him.
The case also received other care Roy Rosselló – a former member of the band Menudo – said Joseph I had sexually abused him.
Rosselló’s claims align with what Erik and Lyle said about their father during the first trial. That trial ended with a hung jury and a judge banned them from presenting their claims at the retrial.
