THE donald trump “resorted to crimes” after losing the 2020 election, federal prosecutors said in a court filing filed Wednesday that argues the former president is not entitled to immunity from prosecution for his failed bid to remain in office.
OR the filing was done by Special Counsel Jack Smith’s team following a Supreme Court opinion granting broad immunity to former presidents for official acts carried out during their term of office, narrowing the scope of the charge that accuses Trump of conspiring to overturn the results of the election he lost to Democrat Joe Biden.
The purpose of the memo is to convince U.S. District Judge Tanya Chutkan that the crimes charged in the indictment are private and unofficial acts and therefore can continue to be part of the indictment as the case progresses.
“Although the defendant was acting president during the alleged conspiracies, his scheme was essentially private,” Smith’s team said. “Working with a group of private conspirators, the defendant acted as a candidate when pursued various criminal means to disrupt, through fraud and deceit, the operation of the government by which votes are collected and counted – a role in which the defendant, as President, had no official role”.
