Diddyhas one small reason to smile despite being behind bars in federal custody… a judge just threw out the $100 million judgment in his Michigan sexual assault lawsuit.
The struggling rapper scored the legal victory during a motion hearing on Wednesday…where his attorney, David Finkconvinced the judge to let go of mass judgment because arrested Derrick Lee Cardello-Smith — who alleges Diddy drugged and sexually assaulted him at a Detroit party in 1997 — failed to prove he actually served his lawsuit under Michigan law.
Judge Anna Maria Anzalone also revoked the temporary restraining order that prevented Diddy from selling any assets to cover damages… noting that Diddy is likely to win the case based on the statute of limitations because Cardello-Smith’s allegations date back to an alleged incident in 1997.
With the default judgment overturned, the case will proceed like any other lawsuit. Diddy’s next expected step would be to file a motion to dismiss the case altogether.
As we reported… Diddy did not file a response to Cardello-Smith’s lawsuit, which is why the judge initially handed the inmate the $100 million judgment he was asking.
