The lawyers of his mother and sister, Roi Pavleas and Spyros Charitatos, filed a request with the Supreme Court prosecutor to appeal the first instance decision on the basis of which the two defendants were acquitted by a majority for the murder of journalist Giorgos Karaivaz.
The family advocates of the murdered journalist visited the Supreme Court prosecutor, Georgia Adelini, today and, as they highlighted in their statements, upon leaving the court, the top prosecutor informed them that she had already intervened ex officio and appointed a deputy prosecutor of the Supreme Court to consider the possibility of appealing against the acquittal decision.
In their application, the lawyers for the journalist’s mother and sister stress that the MOD’s decision “is absolutely null and void and violates the publicity of the trial, because, as the prosecutor at the headquarters also noted and as recorded in the minutes, the relevant legible 33 that was on the CD is damaged. However, the court wrongly considered that even if destroyed it can be considered read. Therefore, the publicity of the procedure was violated in accordance with article 510, paragraph 1, A and C of the Penal Code and the contested decision is attributed to its violation under the terms of article 171, paragraph 1, letter d, of the Penal Code. of absolute nullity during the proceedings in court and violation of the publicity of the proceedings”.
They also point out that the first instance decision suffers from a “lack of special grounds required by the Constitution”, adding that “the provisions of articles 93, paragraph 3, of the Constitution and 139 of the CPD require special and detailed grounds for the decision, not only in the judgment of guilt or innocence, but also includes the mention of the evidence, from which the court was led to its judgment of conviction …”.
The lawyers for the mother and sister further stress in their application that “obviously false statements were taken into account, while the highly valuable testimony of police officer Lambros Kolovos, who played a regulatory role in the investigation of the murder, was not included in the reason for rejection is recalled”.
The request also highlights “how the aforementioned witness gave testimony in an impeccable manner, taking into account and referring to the other police witnesses and analyzing the video material”.
