The judge in Alec Baldwin‘s New Mexico manslaughter case is criticizing prosecutors for misconduct, which she says prevented the actor from preparing his defense.
In new documents obtained by TMZ, the judge who dismissed the case against Alec says the prosecution “intentionally and deliberately” withheld evidence from Baldwin’s legal team…namely, live ammunition found on the set of the movie “Rust” that matched the actual bullet that killed him. Remember… during the trial, the police investigator Marissa Poppell testified that her superiors instructed her to create a report documenting that police had received ammunition and to file it under a case number other than the “Rust” case… so that it would not be visible to the defense.
District Court Judge Mary Marlowe Summer quashed the charge in his final written order… saying his “willful and deliberate misconduct” gave him no choice but to reject the case.

The judge further criticized prosecutors for “egregious discovery violations that constitute misconduct and false testimony obtained during the trial.”
Alec’s case was dismissed last month and he is now taking steps to process Sheriff of Santa Fe Adam Mendoza and special prosecutor Kari Morrisseywho is suffering the brunt of the judge’s wrath here.
Meanwhile, Alec is back in New York. filming their new reality show with his family.
