Almost four months later police responded to a confrontation between Kim Zolciak and Kroy Biermann, separated spouses were ordered to pay for a parental fitness evaluator amid their ongoing contentious divorce.
According to court documents obtained by ET on Tuesday, the court ruled that it is necessary to bring in Dr. Leroy E. Reese, Ph.D, to evaluate Zolciak and Biermann with regard to their suitability as parental guardians of their four children – Kroy “KJ” Jagger Jr., 12, Kash, 11, and twins Kaia Rose and Kane Ren, 9.
Both Biermann and Zolciak will be responsible for paying for the appraiser’s services in equal shares – a total of $5,000, meaning both parties will have to shell out $2,500.
According to the documents, Reese may eventually request a custody evaluation if the parental fitness evaluation is not sufficient. However, Reese will not be allowed to make any recommendations as to which parent should receive custody, if that were to occur.
The parental fitness assessment decision takes place several months after the pair was ordered to appear and complete mediation until January 31, 2024. According to court documents obtained by ET at the time, both parties were required to participate in a mediation process, organized through Fulton County’s alternative dispute resolution program.
This mediation order came after the estranged couple got into such an explosive fight that one of his children felt compelled to call 9-1-1.
According to the Milton Police Department incident report and the Alpharetta Police Department event report obtained by ET, one of the estranged couple’s children called police on Nov. 20 regarding a “domestic verbal disturbance.” at his mansion in Alpharetta, Georgia. .
The report states that police arrived shortly after 7 p.m. after the young man who called 911 “advised that his father was hitting his mother.” The responding officer asked Biermann what led to the argument. He responded by saying that it doesn’t matter “because nothing will happen like last time.” When the officer tried to engage with him again, Biermann became “verbally combative.”
Eventually, after speaking with the children in the home, police were able to calm tensions between Biermann and Zolciak, and Biermann eventually left the residence with some of his belongings.
The violent fight occurred just a month after the judge in the divorce case ordered them to behave civilly towards each other, and “especially in the presence of minor children.”
This incident was at least the third time the police were called as the divorce continued to drag on. Just one day before they asked for divorcepolice were called to the home on May 4 after Biermann claimed Zolciak punched him in the head. In June, Zolciak called police alleging that Biermann threatened to have her friend arrested for kidnapping his son after she gave her friend permission to take her son to a rodeo show. But when asked if she needed police assistance, Zolciak refused.
Zolciak and Biermann first filed for divorce in May 2023, after 11 years of marriage — and rejected the request soon after. Then, in August, Biermann filed for divorce for the second time. The following month, Zolciak filed a motion to dismiss her second divorce petition, claiming they were still having sex, but Biermann responded by saying the request was just a “delay tactic.” The divorce proceedings continued to be controversial in the following months.
